Rhode Island Health Insurance Laws
Rhode Island law allows insurance companies to deny coverage due to health problems. The exception is individuals who are HIPAA eligible; they are guaranteed coverage and will not have an exclusion period. Check with your state insurance department for eligibility requirements.
No individual who has had 12 months of continuous coverage prior to application can be rejected for coverage from any insurance company. Pre-existing conditions can be temporarily excluded with the imposition of a maximum exclusion period of 12 months, or permanently excluded with the use of an elimination rider. Pregnancy qualifies as a pre-existing condition, genetic information does not.
It should be noted that Blue Cross Blue Shield of Rhode Island imposes shorter exclusion periods or none at all. There are no regulations limiting premium prices. It is prohibited for insurance companies to cancel your policy because you become sick.
